Abstract

Amal Sethi’s dissertation tries to lay down a unified theory for constitutional courts in developing democracies that are at a risk of backsliding and answers the following questions: (1) how should constitutional judicialization in developing democracies take place; (2) what has gone wrong with the current wave of constitutional judicialization in developing democracies; (3) what is the role of a constitutional court in developing democracies; (4) how should constitutional courts perform their role in developing democracies; (5) how should constitutional courts ensure their institutional survival in developing democracies.
